Socage North America Website Terms of Service
Terms of Service
Effective date: January 1, 2025
1. Acceptance of These Terms
These Terms of Service (the “Terms”) govern your access to and use of socagenorthamerica.com and any related pages, forms and content (together, the “Site”). The Site is operated by Socage North America LLC (“Socage North America,” “we,” “us” or “our”). By accessing or using the Site, you agree to these Terms. If you do not agree, do not use the Site.
If you use the Site on behalf of a company or other organization, you confirm that you have authority to accept these Terms on its behalf, and “you” includes that organization.
2. About Us
Socage North America LLC is a New Hampshire limited liability company and the North American subsidiary of Socage S.r.l. of Carpi, Italy. We import, sell and support Socage aerial work platforms, Socage Raptor spider lifts, truck-mounted lifts and related parts, directly and through a network of authorized dealers in the United States and Canada.
3. Eligibility
The Site is intended for business and professional users who are at least 18 years old. It is not directed to children, and we do not knowingly collect information from anyone under 18.
4. Product Information, Pricing and Quotes
The Site provides general information about our products, parts, services and dealers. Specifications, working heights, capacities, outreach figures, configurations, options, photos, availability and any prices shown are for general reference only. They may vary by model year, market, configuration and applicable U.S. or Canadian standards, and they may change without notice.
Nothing on the Site is an offer to sell. A contract for equipment, parts or services is formed only through a written quotation, order confirmation, sales agreement or service agreement issued by Socage North America or an authorized dealer. Those documents, including their warranty, payment, delivery, risk of loss and limitation of liability terms, govern the transaction and control over anything on the Site.
The Site does not offer user accounts, online ordering or online payment. We will never ask you to pay or submit financial account information through a Site form.
5. Equipment Safety
Aerial work platforms can cause serious injury or death if operated, inspected or maintained improperly. Content on the Site, including videos, articles, FAQs, troubleshooting tips and support responses, is general information. It is not a substitute for:
- The operator’s manual, safety manual, decals and maintenance documentation supplied with the machine
- Operator and occupant training and familiarization required by applicable standards, including ANSI/SAIA A92 in the United States and CSA B354 in Canada
- Frequent, annual and other inspections required by those standards, OSHA and provincial occupational health and safety regulations
- Qualified, trained service personnel for repairs and adjustments
Always follow the manufacturer’s documentation and applicable law. If anything on the Site conflicts with the machine’s manuals or decals, the manuals and decals control. Do not attempt repairs, modifications or overrides of safety systems based on Site content. Contact us or an authorized dealer for service.
6. Contact, Support and Service Requests
You may use Site forms to request information, quotes, demonstrations, parts, service or technical support. When you submit a request, you agree to provide accurate information, including machine model and serial number where relevant.
Submitting a request does not create a contract, guarantee a response time or confirm warranty coverage. Warranty eligibility is decided under the written warranty that applies to your machine. The Site is not monitored for emergencies. If a machine malfunctions with a person in the platform or presents an immediate hazard, follow the emergency lowering procedures in the operator’s manual and contact emergency services where appropriate.
7. Authorized Dealers
The Site may identify authorized dealers or route your inquiry to a dealer serving your area. Dealers are independent businesses, not agents, employees or joint venturers of Socage North America. We are not responsible for a dealer’s own statements, pricing, quotes, services or performance, except as stated in a written agreement we sign with you. A dealer listing on the Site may change and does not guarantee that a dealer carries a particular model or part in stock.
8. Acceptable Use
You agree not to:
- Use the Site for any unlawful, fraudulent or misleading purpose
- Submit false information, impersonate any person or business, or submit requests on behalf of others without authority
- Send spam, unsolicited advertising or bulk submissions through Site forms
- Upload viruses, malware or any code designed to disrupt, damage or gain unauthorized access to the Site or our systems
- Scrape, harvest or copy Site content, pricing or dealer data by automated means, except search engine indexing
- Probe, scan or test the vulnerability of the Site, or bypass any security or access control
- Use Site content to build or train a competing product catalog, database or service
We may block access, delete submissions or take other action if we believe these Terms have been violated.
9. Your Submissions
You retain ownership of information, photos, videos and documents you send us (“Submissions”). You grant us a non-exclusive, royalty-free license to use, copy and share your Submissions with Socage S.r.l., our authorized dealers and service providers as needed to respond to you, provide service and support, process warranty claims and improve our products.
If you send feedback, ideas or suggestions about our products or Site, we may use them for any purpose without obligation to you. Do not send confidential or proprietary information through the Site unless we have agreed in writing to receive it on a confidential basis.
10. Intellectual Property and Trademarks
The Site and its content, including text, images, video, drawings, specifications, documents, software and design, are owned by or licensed to Socage North America and Socage S.r.l. and are protected by copyright, trademark and other laws.
SOCAGE, RAPTOR, SOCAGE RAPTOR, MYSOCAGE and related logos and product names are trademarks of Socage S.r.l., used under license. Other trademarks on the Site belong to their respective owners. Nothing in these Terms grants you a right to use any of these marks without our prior written permission, except that authorized dealers may use them as permitted in their dealer agreements.
You may view, download and print Site content, including brochures and specification sheets, for your own internal business use in evaluating or using our products, provided you keep all copyright and proprietary notices. Any other copying, modification, distribution or commercial use requires our prior written consent.
11. Third-Party Links and Services
The Site may link to or embed content from third parties, such as Socage S.r.l.’s global website, video platforms, maps, social media, financing providers and dealer websites. We do not control and are not responsible for third-party sites or services, and a link is not an endorsement. Your use of them is governed by their own terms and privacy policies.
12. Privacy and Electronic Communications
Our Privacy Policy explains how we collect, use and share personal information submitted through the Site, including sharing with authorized dealers and with Socage S.r.l. in Italy for support, warranty and product purposes. By using the Site, you acknowledge the Privacy Policy.
By submitting a form, you agree that we and our authorized dealers may contact you by email or phone about your request. We will send marketing emails only as permitted by the U.S. CAN-SPAM Act and, for recipients in Canada, Canada’s Anti-Spam Legislation (CASL), and every marketing email will include a way to unsubscribe. We will not send marketing text messages or autodialed or prerecorded calls without your prior express written consent.
13. Disclaimer of Warranties
THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, REGARDING THE SITE AND ITS CONTENT, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, ERROR-FREE OR FREE OF HARMFUL COMPONENTS, OR THAT ITS CONTENT IS COMPLETE, ACCURATE OR CURRENT.
This section applies to the Site only. Warranties on equipment and parts are provided solely by the written warranty delivered with the product or stated in your sales agreement.
14. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, SOCAGE NORTH AMERICA, SOCAGE S.R.L. AND THEIR AFFILIATES, OFFICERS, EMPLOYEES AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, BUSINESS OR DOWNTIME, ARISING OUT OF OR RELATING TO YOUR USE OF, OR INABILITY TO USE, THE SITE OR ITS CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US$100).
These limits do not apply to liability that cannot be limited under applicable law, including liability for death or personal injury caused by our negligence where such a limit is prohibited. Liability relating to equipment, parts or services you purchase is governed by the applicable sales, service or warranty documents, not by this section.
15. Indemnification
You agree to defend, indemnify and hold harmless Socage North America, Socage S.r.l. and their affiliates, officers, employees and agents from any claims, losses, damages, liabilities and expenses, including reasonable attorneys’ fees, arising from your violation of these Terms, your misuse of the Site, or Submissions you provide.
16. Export Controls and Sanctions
Our products, parts and technical information are subject to U.S. and Canadian export control and sanctions laws. You may not use the Site to request products, parts or technical data for export, re-export or transfer to any country, entity or person prohibited under those laws, including persons on U.S. OFAC or Canadian sanctions lists. You confirm that you are not such a person.
17. Users in Canada
If you are located in Canada, these Terms apply to the extent permitted by applicable provincial and federal law, and nothing in them limits rights you have that cannot be waived under that law. Product suitability for use in Canada, including CSA certification, is confirmed only in a written quotation or sales agreement.
The parties have expressly required that these Terms and all related documents be drawn up in English. Les parties ont expressément exigé que les présentes conditions et tous les documents connexes soient rédigés en anglais.
18. Governing Law and Disputes
These Terms and any dispute arising out of or relating to them or the Site are governed by the laws of the State of New Hampshire, without regard to its conflict of laws rules. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Terms.
Subject to the arbitration provision below, you agree to the exclusive jurisdiction of the state and federal courts located in Rockingham County, New Hampshire, and waive any objection to venue there.
Any dispute arising out of or relating to these Terms or the Site will be resolved by binding arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, before a single arbitrator seated in New Hampshire. Either party may bring an individual claim in small claims court or seek injunctive relief for intellectual property misuse in court. Claims must be brought in an individual capacity, not as a plaintiff or class member in any class or representative proceeding.
19. Changes to These Terms
We may update these Terms from time to time by posting a revised version on the Site with a new effective date. Changes apply from that date. Your continued use of the Site after a change means you accept the revised Terms.
We may also change, suspend or discontinue any part of the Site at any time without notice.
20. General
These Terms, together with the Privacy Policy, are the entire agreement between you and us about the Site. They do not replace or amend any quotation, sales, service, warranty or dealer agreement, which control for their subject matter. If any provision is found unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them to an affiliate or successor. Sections 9 through 18 survive any termination of your use of the Site.
